As part of the current reorganisation procedure, we would like to inform you about the different regulations that apply to returns, depending on the time of purchase and return. Below you will find an overview of the relevant cases and the respective procedures:
Case 1: Purchase of the goods before the opening of insolvency (including 16 October 2024) proceedings and delivery of your return according to the consignment tracking before the opening of insolvency (including 16 October 2024) proceedings:
In this case, customers can file an insolvency claim with the commercial court, subject to a flat fee of €25. You can find the registration form here. The registration deadline is 23 December 2024.
You can also file insolvency claims via one of the following creditor protection organisations:
– Credit Protection Association of 1870: ins.forderungen@ksv.at
– Alpine Creditors’ Association: forderungsanmeldung@akveuropa.at
– Austrian Creditreform Association: office@insolvenz.creditreform.at
The goods will not be returned or exchanged.
Case 2: Purchase of the goods before the opening of insolvency ((including 16 October 2024) proceedings and delivery of your return according to the consignment tracking after the opening of insolvency (from 17 October 2024) proceedings:
The goodwill rule applies here, subject to availability in the online shop, which allows you to exchange the goods for a different size or goods of the same price. The value of the exchanged goods may neither exceed nor fall below the value of the returned goods. However, this regulation only applies if the goods have been returned free of defects and there is a promise that the returned goods can be resold without a discount.

Case 3: Purchase of the goods before the opening of insolvency (including 16 October 2024) proceedings and delivery of your return according to the consignment tracking after the opening of insolvency (from 17 October 2024) proceedings with reclaim of the purchase price:
If you do not want an exchange in accordance with case 2, you only have the option of filing an insolvency claim with the commercial court or with the above-mentioned creditor protection organisations.
Case 4: Purchase of the goods after the opening of insolvency (from 17 October 2024) proceedings and delivery of your return according to the consignment tracking after the opening of insolvency (from 17 October 2024) proceedings:
If the purchase and the return of the goods took place after the opening of insolvency proceedings, you will receive a full refund of the purchase price. As Lena Hoschek GmbH is currently undergoing restructuring proceedings without self-administration, refunds may only be made by the restructuring administration and only by bank transfer (regardless of the payment method originally used). As a result, there are currently longer processing times for refunds. We request that you provide us with your bank details if you return ordered goods to Lena Hoschek GmbH.
