As part of the current reorganisation procedure, we would like to inform you about the different regulations that apply to returns, depending on the time of purchase and return. Below you will find an overview of the relevant cases and the respective procedures:

Case 1: Purchase of the goods before the opening of insolvency proceedings and delivery of your return according to the consignment tracking before the opening of insolvency proceedings:
In this case, customers can file an insolvency claim with the commercial court, subject to a flat fee of €25. You can find the registration form here.

You can also file insolvency claims via one of the following creditor protection organisations:

– Credit Protection Association of 1870: ins.forderungen@ksv.at
– Alpine Creditors’ Association: forderungsanmeldung@akveuropa.at
– Austrian Creditreform Association: office@insolvenz.creditreform.at

The goods will not be returned or exchanged.

Case 2: Purchase of the goods before the opening of insolvency proceedings and delivery of your return according to the consignment tracking after the opening of insolvency proceedings:The goodwill rule applies here, subject to availability in the online shop, which allows you to exchange the goods for a different size or goods of the same price. The value of the exchanged goods may neither exceed nor fall below the value of the returned goods. However, this regulation only applies if the goods have been returned free of defects and there is a promise that the returned goods can be resold without a discount.

Case 3: Purchase of the goods before the opening of insolvency proceedings and delivery of your return according to the consignment tracking after the opening of insolvency proceedings with reclaim of the purchase price:If you do not want an exchange in accordance with case 2, you only have the option of filing an insolvency claim with the commercial court or with the above-mentioned creditor protection organisations.

Case 4: Purchase of the goods after the opening of insolvency proceedings and delivery of your return according to the consignment tracking after the opening of insolvency proceedings:If the purchase and the return of the goods took place after the opening of insolvency proceedings, you will receive a full refund of the purchase price as usual.

If you return your order, an exchange is possible as a gesture of goodwill, subject to availability in the online shop. An exchange for a different size or goods of the same price. However, you are not entitled to a refund of the redeemed gift card. If you decide in favour of an exchange, please send us an e-mail to onlineshop@lenahoschek.com. If you do not want an exchange, you only have the option of filing an insolvency claim with the commercial court or with the above-mentioned creditor protection organisations.

Unfortunately, gift cards can no longer be redeemed. However, you have the option of registering these as an insolvency claim with the competent commercial court after carrying out your own financial check. Please note that this will incur a flat fee of € 25.

Alternatively, you can also register your insolvency claim via one of the creditor protection organisations. You can also obtain further information from the creditor protection associations under which voucher creditors can register:

Guarantee or warranty claims for items purchased before the opening of insolvency proceedings must unfortunately be asserted as insolvency claims at the competent commercial court.
